Legalize Existing ADU
Does your property have an unpermitted ADU or JADU constructed? Has a garage, basement, or other room been converted into a separate living unit without obtaining a building permit?
The City of Mountain View has a process to legalize unpermitted ADUs. No code enforcement action or penalties will be assessed on unpermitted ADUs.
Eligible Properties
- The unit was built or converted prior to January 1, 2020;
- There is not an existing building permit for the unit; and
- The zoning of the property allows for an ADU

Your Pathway To A Legalized ADU
These steps provide an overview of the ADU legalization process. Each project is unique and may require modifications to this process.
- Review the Regulations. Review the zoning and building code requirements to determine if the program is right for you.
- Contact the City. Contact the Planning Division for questions related to ADU zoning regulations. Contact the Building Division to discuss building code and building permit requirements.
- Additional Research. Conduct research, as needed, to understand the costs and benefits associated with having an ADU on your property. For example, consult a tax advisor to understand any property tax implications.
- Draft Building Plans. Work with an architect/ engineer to prepare building plans. Plans must comply with the City’s ADU
- Standards. Submit Plans to City Submit a building permit application to the Building Inspection Division at www.mountainview.gov/building.
- Building Permit Issuance. The plans may require more than one round of City review. Once plans are in good order, a building permit will be issued.
- Construction and Inspections. Once building permits are issued, construction may commence. You may schedule inspections online.
- Legal ADU. Once construction and all necessary inspections are completed, the unit is legal.
